THE High Court has declared as unconstitutional South Australia's controversial bikie laws banning members from associating.
The judgment throws into doubt a key aspect of South Australia's Serious and Organised Crime Control Act, where restrictions could be placed on gang members without a court having the power to review the evidence.
The High Court has sided with the Finks motorcycle club, which challenged South Australia's laws.
The decision upholds a ruling by the SA Supreme Court in 2009 that found aspects of the state's anti-bikie laws to be unconstitutional.
The South Australian Government has been ordered to pay costs to Finks motorcycle gang members Sandro Totani and Donald Hudson.

HE NSW government says its anti-bikie laws are different from those in South Australia and will not be affected by the High Court's decision on SA's legislation.
In its judgment today the High Court ruled against provisions in the SA legislation, which allowed for control orders to be slapped on gang members without a court having the power to see or review the evidence relied on.
The High Court sided with two members of the Finks motorcycle club who had challenged the SA laws, winning a judgement in the Supreme Court last year.
NSW Attorney-General John Hatzistergos said South Australian legislation was differently structured.
"The NSW and indeed the legislation of a number of other jurisdictions which have followed NSW is very different," Mr Hatzistergos told reporters today.
"We did take very senior constitutional advice when we drafted our legislation and that's the reason why a number of variations were undertaken in drafting NSW legislation compared to that which was enacted in South Australia.

After Last Saturday May 1st Police intimidation. All Bike Riders are being targeted. Check out the photos. one and half hours in the hot sun. There are a lot of social riders in the group. Even Pillons licences were checked. All I own up to being is a Baby Boomer ! Yep no help with cheap housing loans, or baby payments. No way ! we rode motorbikes to get to work and to do our courting. Now the kids are gone and we have freedom -------we want to ride with friends and now we are outlaws? Come on ! Express your views.
